1. Acceptance of Terms

Welcome to SFRD! These Terms of Service ("Terms") govern your access to and use of the SFRD website and any related services, applications, and features (collectively, the "Portal"). By accessing or using the Portal, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Cookie Policy, Community Guidelines and Copyright Policy, which are incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Portal.

2. Important Disclaimers – Not Medical Advice

THE INFORMATION PROVIDED ON THIS PORTAL IS FOR INFORMATIONAL, EDUCATIONAL, AND SUPPORT PURPOSES ONLY AND IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. Reliance on any information provided by SFRD, our employees, others appearing on the Portal at the invitation of SFRD, or other visitors to the Portal is solely at your own risk.

3. Eligibility

You must be at least 18 years old to use this Portal. By using the Portal, you represent and warrant that you are of legal age to form a binding contract with SFRD and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Portal.

4. User Accounts

Account Creation: To access certain features of the Portal, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify SFRD immediately of any unauthorized use of your account. SFRD cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

Multiple Accounts: You may not create more than one account.

5. User Responsibilities and Prohibited Conduct

You agree to use the Portal only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate Laws: Use the Portal in any way that violates any applicable central, state, local, or international laws or regulations.
  • Harm Others: Engage in any conduct that is harassing, threatening, defamatory, obscene, hateful, discriminatory, or otherwise objectionable. This includes posting content that encourages violence, hate speech, or illegal acts.
  • Misrepresent Identity: Impersonate or attempt to impersonate SFRD, an SFRD employee, another user, or any other person or entity.
  • Distribute Harmful Content: Upload, post, or transmit any material that contains viruses, Trojan horses, worms, logic bombs, or other malicious or technologically harmful material.
  • Interfere with Operations: Interfere with or disrupt the operation of the Portal or the servers or networks connected to the Portal, including by attempting to probe, scan, or test the vulnerability of any system or network.
  • Scrape/Extract Data: Use any robot, spider, or other automatic device, process, or means to access the Portal for any purpose, including monitoring or copying any of the material on the Portal.
  • Solicit Medical Advice from Users: While discussion of personal experiences is encouraged, do not actively solicit or provide specific medical advice, diagnosis, or treatment recommendations to other users within public forums.
  • Commercial Use/Spam: Use the Portal for any commercial purpose without SFRD's express written consent, including sending unsolicited advertisements or promotional materials ("spam").
  • Infringe IP: Post, upload, publish, submit or transmit any content that infringes, misappropriates or violates a third party's patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy.

6. User-Generated Content

Responsibility for Content: You are solely responsible for all content, including text, images, videos, and other materials, that you upload, post, publish, display, or otherwise transmit ("Post") on the Portal.

Grant of License: By Posting content on the Portal, you grant SFRD a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, for the purpose of operating, improving, and promoting the Portal and SFRD's mission.

Representations and Warranties: You represent and warrant that: (i) you own or control all rights in and to your User Content and have the right to grant the license granted above to us and our affiliates and service providers; and (ii) all of your User Content does and will comply with these Terms and our ‘Community Guidelines’.

Monitoring and Enforcement: SFRD has the right to:
  • Remove or refuse to Post any User Content for any or no reason in our sole discretion.
  • Take any action with respect to any User Content that we deem necessary or appropriate in our sole discretion, including if we believe that such User Content violates the Terms, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Portal or the public, or could create liability for SFRD.
  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  • Terminate or suspend your access to all or part of the Portal for any or no reason, including without limitation, any violation of these Terms.

7. Intellectual Property Rights

The Portal and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SFRD, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Portal, except as generally and naturally occurs during normal website viewing.

8. Third-Party Links and Services

The Portal may contain links to third-party websites or services that are not owned or controlled by SFRD. SFRD has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that SFRD shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

9. Disclaimer of Warranties

YOUR USE OF THE PORTAL IS AT YOUR SOLE RISK. THE PORTAL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SFRD EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SFRD MAKES NO WARRANTY THAT (i) THE PORTAL WILL MEET YOUR REQUIREMENTS; (ii) THE PORTAL WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE PORTAL WILL BE ACCURATE OR RELIABLE; OR (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE PORTAL WILL MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SFRD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PORTAL; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PORTAL; (iii) ANY CONTENT OBTAINED FROM THE PORTAL; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Indemnification

You agree to defend, indemnify, and hold harmless SFRD, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Portal, including, but not limited to, your User Content, any use of the Portal's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Portal.

12. Governing Law and Jurisdiction

All matters relating to the Portal and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of India without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Portal shall be instituted exclusively in the Courts of India, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

13. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Portal thereafter. Your continued use of the Portal following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

14. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

15. Entire Agreement

These Terms and our Privacy Policy, Cookie Policy, Community Guidelines, and Copyright Policy constitute the sole and entire agreement between you and SFRD regarding the Portal and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Portal.
